Privacy policy

Thank you for visiting the Eckstein Biokosmetik USA, Inc. website!  We appreciate the importance of your trust and we respect your concerns about privacy, because we value the business relationship we have with you. This Privacy Policy (“Policy”) describes the types of personal information we obtain from our customers, how we use the information, with whom we share it, and the choices available to our customers regarding our use of that information.  We also describe the measures we take to protect the security of the information and how our customers can contact us about our privacy practices.

Your use of our website, web pages, sponsored social media platforms, mobile sites and mobile applications or “apps” (collectively, “Sites”), if any, constitutes your acceptance of this Policy in its entirety and your full consent to the practices which are described throughout this Policy.

 

I. SCOPE OF THIS POLICY 

This Privacy Policy covers online data collection and our use practices regarding our Site by the owner of our online website, in the United States of America (“USA”), Eckstein Biokosmetik USA, Inc., a California corporation (collectively, “We”, “US”, or “Our”). 

This Policy applies specifically to Our sales and sales operations conducted in the USA, only, and is not applicable to online purchases or sales of Our products from Our Sites which may be placed from online sources which are located in countries other than the USA. 

YOU SHOULD CAREFULLY READ THIS PRIVACY POLICY.

By accessing, browsing, and/or otherwise using the Sites and/or Site Offerings, you are creating a binding contract between you and us, and you are acknowledging that you have read, understood, and agreed to be bound by this Privacy Policy, in its entirety. If you do not agree with the terms and conditions of this Privacy Policy in their entirety and/or would prefer that we not collect, use, or disclose your Personal Data as described herein, you should not use the Sites and/or Site Offerings, or otherwise provide us with any information.

 

II. COLLECTION OF INFORMATION

You may visit and browse Our Sites without providing any Personally Identifiable Information, as that term is defined and described in California Business and Professions Code section 22577(a), (“PII”).  However, this may limit your ability to receive certain features, products or services from Us.

A. Information You Provide

We collect information you provide directly to us. For example, you share information directly with us when you create an account, fill out a form, submit a product review through our Websites or comment on our blog, make a purchase, call or text us on the phone, communicate with us via third-party platforms and on social media, sign up to join our email list, request customer support, or otherwise communicate with us. We may obtain your PII, which is information that can be used to identify you as an individual, including, but not limited to your name, email address, shipping and billing postal address, phone number, credit card and other payment information, information about your skincare needs or concerns, product preferences, and any other information you choose to provide.

B. Information We Collect Automatically when you Interact with us

 When you order from Our Sites, we obtain PII about your usage and/or internet-connected device by automated means such as “cookies.” Cookies are small data files that websites send to your internet-connected device for the purpose of uniquely identifying your browser, and/or to store information settings in your browser. Your browser may tell you how to be notified when you receive certain types of cookies, and/or how to restrict or disable certain cookies.

Please note, however, that without cookies, you may not be able to use all of the features of Our Sites. By way of example, if you use one of Our mobile applications, we may collect your unique identifier (or other device identifier) and/or Geo-location Data, through the use of cookies, in order to offer you certain features or functions within that mobile application.

In conjunction with obtaining information through cookies, our web servers may log details such as your operating system type, browser type, domain, and other system settings, as well as the language your system uses and the country and time zone in which your device is located (“Geo-location Data”).

C. Information Which We May Obtain from Third Parties

We may also obtain information about you from third parties that feature Our products, or from social media platforms, and/or social networking or other websites which you may visit. You may also choose to participate in a third party application or social media site, through which you allow Us to obtain (or the third party to share with Us) information about you, including PII. The information which might be obtained from such third parties, might also be collected through technologies such as cookies, web server logs, pixels, and/or web beacons.  If we obtain such information about you (including PII) from third parties, such information and data about you is also subject to this Policy, unless we have disclosed otherwise, or unless you have instructed us to the contrary.

D. Your Consent to the Use and Sharing of Your Information by Us 

Your PII may also be used by Us, and/or shared with Our subsidiaries, affiliates, sponsors, partners, or other third parties, for the purposes of: responding to your questions and requests; providing you with access to certain areas and features of Our Sites; verifying your identity; fulfilling your product purchases; communicating with you about your account and your activities on Our Sites; sending you notice of changes to any of Our policies; tailoring content, advertisements, and offers We provide you; improving Our Sites for Our business purposes and practices; allowing you to log in with a social media account and share activities on your social media pages (such as Facebook); processing your applications and transactions; and providing you with product information and promotional and other offers on Our Sites.

Except as provided in this Policy, We will not provide any of your PII to any third parties without your consent. We may, however, share non-PII, such as aggregate user statistics, demographic information and the like with third parties.

E. Legal and Governmental Disclosure

We may transfer and/or disclose information, including your PII, to third parties, in order to:  comply with a requirement from a legal or other governmental authority, obligation or a duty imposed by law; when we believe in good faith that such a disclosure or transfer of information is required by law and/or is necessary or appropriate to prevent physical harm or financial loss; at the request of governmental or legal authorities conducting an investigation; to verify and enforce the terms of this Policy; to respond to an emergency; and otherwise to protect your rights, property, safety, and security, as well as the rights, property, safety, and security of third parties, visitors to Our Sites, or the public.

 

 

III. THIRD PARTY SERVICES

A. Shopify

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

B. Other Third Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

III. ANALYTICS 

We allow others to provide analytics services and serve advertisements on our behalf across the web and in mobile apps. These entities may use cookies, web beacons, pixels, device identifiers, and other tracking technologies to collect information about your use of our Websites and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, and conversion information. This information may be used by Eckstein BioKosmetik USA, Inc. and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Websites and other websites, and better understand your online activity.

The Analytics Services we use include, but are not limited to:

A.      Google® Analytics. Our Sites may use a tool called “Google Analytics®.” We may combine the information collected through the use of Google Analytics® with Personal Data. Google’s® ability to use and disclose information collected by Google Analytics® about your visits to and use of our Sites is restricted by the Google Analytics® Terms of Service, available here, and the Google® Privacy Policy, available here. IV. ADVERTISING

We also work with third parties to serve ads to you as part of customized campaigns on third-party platforms (such as Facebook and Instagram). As part of these ad campaigns, we or the third-party platforms may convert information about you, such as your email address and phone number, into a unique value that can be matched with a user account on these platforms to allow us to learn about your interests and serve you advertising that is customized to your interests. Note that the third-party platforms may offer you choices about whether you see these types of customized ads.

We utilize various tracking methods to enhance our marketing and improve user experiences, including the following:

  • Facebook Ads:  We may use Facebook Ads to deliver targeted content to you based on your interests and interactions with our services.
  • Google Ads:  Google Ads may be employed to display relevant advertisements based on your interactions with our services.
  • YouTube Ads:  We may use YouTube Ads to promote our products or services based on your preferences.
  • Email Marketing:  Your email address may be used to send marketing materials related to Eckstein BioKosmetik USA, Inc..  You can opt out of these communications at any time.
  • Cookie Tracking:  Cookies help us collect data to enhance your experiences on Eckstein BioKosmetik USA, Inc.’s Websites.
  • TikTok Ads Tracking: TikTok Ads may be used to deliver targeted content to you.

 

Text marketing (if applicable): With your permission, we may send text messages about our store, new products, and other updates. Updates include Checkout Reminders. Webhooks will be used to trigger the Checkout Reminders messaging system.

We offer various financial incentives. For example, we may provide discounts, coupons, and other benefits for users who sign up to receive our marketing emails or join our loyalty program. When you participate in a financial incentive, we collect personal information from you, such as identifiers (like your name and email address) and commercial information (like your purchase history). You can opt into a financial incentive by following the sign-up or participation instructions provided, and you can opt-out of the financial incentive, or our subsequent use of your personal information in connection with a financial incentive, at any time by following the instructions in our promotional emails or by contacting us at sales@ecksteinusa.com. In some cases, we may provide additional terms and conditions for a financial incentive, which we will present to you when you sign up. The value of your personal information is reasonably related to the value of the offer or discount presented to you.

 

V. PRIVACY PROVISIONS FOR CALIFORNIA RESIDENTS ONLY

The California Consumer Privacy Act of 2018 and the California Privacy Rights Act of 2020 (collectively, the “CCPA”), affords consumers residing in California certain rights with respect to their personal information. If you are a California resident, this section applies to you. 

If you live in California, under the California Consumer Privacy Act (“CCPA”), you have the right to request access to and receive information about what data that we have collected about you; have the information restricted or deleted; and/or withdraw your consent to certain uses of your information. These rights may also exist to some lesser degree in other jurisdictions.  You may also have the right to data portability regarding the data you provided to us. You can exercise your rights in one of the methods below:

These Privacy Provisions for California Residents (“CA Privacy Provisions”) supplement the information contained in the Privacy Policy set forth above. These CA Privacy Provisions apply solely to residents of the State of California (“User(s)”). We adopt these CA Privacy Provisions in compliance with the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020) (the “CCPA”). Any terms defined in the CCPA (such as “personal information”) have the same meaning when used in these CA Privacy Provisions.

A. Shine the Light.

California Civil Code Section 1798.83 permits our customers who are California State residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. We may, in certain limited instances, disclose your Personal Data to third parties who perform administrative functions on our behalf. California State residents may request the following information regarding our disclosure of your Personal Data to third parties:

1.      How your Personal Data was disclosed to third parties;

2.      A list of certain categories of Personal Data that we have disclosed to certain third parties during the immediately preceding calendar year; and

3.      A list of certain categories of third parties that received Personal Data from us during that calendar year.

To make such a request, please send an email to sales@ecksteinusa.com. Please note that we are only required to respond to one request per customer each year.

B. Privacy Rights for California Minors in the Digital World.

In addition, if you are a California State resident under eighteen (18) years of age and a registered user, California Business and Professions Code Section 22581 permits you to remove content or Personal Data that you have publicly posted on the Sites. If you wish to remove such content or Personal Data and you specify which content or Personal Data you wish to be removed, we will do so in accordance with applicable law. Please be aware that after removal, you will not be able to restore removed content. In addition, such removal does not ensure complete or comprehensive removal of the content or Personal Data you have posted and, as such, there may be circumstances in which the law does not require us to enable removal of content.

D. Use of Personal Information.

We may use or disclose each of the categories of personal information set forth above for one or more of the following business or commercial purposes (with the specific categories of personal information indicated in parenthesis):

  • To fulfill or meet the reason for which the information is provided. For example, if you provide us with personal information in connection with your purchase of products and/or services, we will use that information to process your order (Category A, B, C, D and F).

We will not collect additional categories of personal information or use the personal information that we collected for materially different, unrelated or incompatible purposes without providing you with notice.

We disclose each of the categories of personal information set forth above for the business and commercial purposes described in the Use of Personal Information section.

F. Selling and Sharing of Personal Information.

We work with other companies and businesses to deliver advertising to you on other sites and services. In working with other companies and businesses, we may disclose personal information in a way that is “selling” or “sharing” personal information as defined under the CCPA.

In the preceding 12 months, we have sold or shared the following category of personal information with third party analytics providers, advertising partners, and ad networks for analytics and advertising purposes.

We do not sell or share any of your sensitive personal information, and do not sell or share the personal information of consumers under 16 years of age.

How Long We Keep Your Personal Information

We generally keep your personal information for as long as necessary to provide our products and services. When deciding how long we need information, we consider the following factors:

  • how long the information is needed to provide our products and services;
  • how long the information is needed to comply with legal or regulatory obligations or to resolve disputes or defend against legal claims;
  • whether the information is needed for other legitimate purposes such as to prevent harm to us or others, including our rights, property, or products; to enforce our terms and policies, or to promote security and integrity.

 

G. Your Rights and Choices

The CCPA provides Users (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

H. Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information. Once we receive and confirm your verifiable User request, we will disclose to you:

    • The categories of personal information we collected about you.
    • The categories of sources for the personal information we collected about you.
    • Our business or commercial purpose for collecting or selling that personal information.
    • The categories of third parties with whom we have shared that personal information.
    • The specific pieces of personal information we collected about you (also called a data portability request).
    • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
      • sales, identifying the personal information categories that each category of recipient purchased; and
      • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

I. Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable User request, we will delete (and direct our service providers to delete) your personal information from our (their) records, unless an exception applies; provided, however, that in some cases, strictly for regulatory compliance purposes and to better evidence/honor opt-out/unsubscribe requests (and for no other purposes), we may retain certain items of your personal information on a de-identified and aggregated basis in such a manner that the data no longer identifies you.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

1.      Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our obligations in connection with our contract with you.

2.      Protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities.

3.      Debug products to identify and repair errors that impair existing intended functionality.

4.      Exercise free speech rights, ensure the right of another User to exercise her/his free speech rights or exercise another right provided for by law.

5.      Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).

6.      Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, but only if you previously provided informed consent.

7.      Enable solely internal uses that are reasonably aligned with User expectations based on your relationship with us.

8.      Comply with a legal obligation.

9.      Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

 

J. Right to Correct.

You have a right to request that we correct inaccurate personal information we maintain about you. We will take into account the nature of the personal information and the purposes for which we process it. We may require documentation from you in order to process your request, including your name, email address, phone number, and request details.

K. Right to limit use and disclosure of sensitive personal information.

You have the right to request that we limit our use and disclosure of sensitive personal information we maintain about you only as necessary to perform the services or provide the goods reasonably expected, or as otherwise permitted by the CCPA.

L. Right to Opt Out of Sale or Sharing.

M. Exercising Access, Data Portability, Deletion, and Correction Rights.

To exercise your access, data portability, deletion, and/or correction rights described above, please submit a verifiable User request to us by either:

1.      Emailing us at: sales@ecksteinusa.com or

2.      Sending us U.S. Mail to: Eckstein BioKosmetik USA Inc., 5910 Sea Lion Place Ste. 100, Carlsbad, CA 92010.

We endeavor to act on all opt-out requests as soon as practicable, but in all cases within fifteen (15) business days of the receipt of your request. Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable User request related to your personal information.

You may only make a verifiable User request for access or data portability twice within a 12-month period. The verifiable User request must:

1.      Provide sufficient information that allows us to reasonably verify that you are: (1) the person about whom we collected personal information; or (2) an authorized representative. If you use an authorized agent to submit a consumer request, the authorized agent must provide documentation or other proof indicating that they are authorized to act on your behalf. For requests to correct, access or delete, we may require you to verify your identity directly with us and directly confirm with us that you provided the authorized agent permission to submit the request.

2.      Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable User request does not require you to create an account with us. We will only use personal information provided in a verifiable User request to verify the requestor's identity or authority to make the request.

N. Response Timing and Format

We endeavor to respond to all verifiable User requests within forty-five (45) days of the receipt thereof. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the twelve (12) month period preceding the receipt of your verifiable request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable User request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

O. Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

1.      Deny you goods or services;

2.      Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;

VI. YOUR PRIVACY RIGHTS, CHOICES AND ACCESS

You may direct Us to not share your PII with third parties, not to use your PII to provide you with information or offers, and/or not to send you newsletters, emails or other communications by: modifying your registered user information on Our Sites; sending us an email at sales@ecksteinusa.com or following the removal instructions in the communication which you may receive from Us.

We respect our customers’ preferences by keeping records of their preferences, and making sure they are always honored. Following a communication from you regarding your preferences, We will implement those preferences within a reasonable period of time.

If you wish to access, modify, verify, correct, delete or update any of your information obtained through Our Sites, you may also edit your profile preferences or contact us at the postal address, telephone number or email address contained in this Policy, below. If you do contact Us for these purposes, We will properly verify your identity and confirm your access right to your own PII.   

In accordance with our routine record keeping, We may also delete certain records that contain PII which you have submitted through Our Sites.  We are under no obligation to store your PII indefinitely, and We expressly disclaim any liability arising out of or related in any manner to the destruction of any such PII in the ordinary course of conducting Our business. 

Additionally, you should also understand that it may not be possible to completely remove or delete all of your information from Our databases without some residual data remaining, due to file backups and other reasons.

We will retain your PII (including Geo-location Data) for as long as your account with Us is active or as-needed to provide you with Our services. If you wish to cancel your account or request that We no longer use your PII to provide you with any services and products, you can contact us at sales@ecksteinusa.com .  

We do not control certain privacy settings and preferences maintained by third parties, such as Facebook, Twitter or other sites which are not Our Sites, and if you would like to make changes to those settings and preferences, you will need to contact them directly.   

You may withdraw your consent which you have provided Us pursuant to this Policy, or object at any time on legitimate grounds to the processing of your PII, and we will apply your preferences going forward. In some circumstances, however, withdrawing your consent to Our use or disclosure of your PII will mean that you may not be able to take advantage of Our products or services.

We may use third party network advertisers to serve and provide advertisements of Our products and services. However, we do not share your PII with these third parties, the advertisement or network providers, the advertisers, and/or the sponsors.

 

VII. CHILDREN’S PRIVACY

The privacy rights of visitors to Our Sites who are under the age of thirteen (13) are very important to us. Our Sites are not directed at children under the age of thirteen (13). By using Our Sites, and/or by providing Us with any information (including PII), you acknowledge that Our Sites are subject to the laws of the USA.
